Limited Liability Indemnity

This page sets out the limits of our liability and your indemnity obligations when you use insectscreenshongkong.com or buy from Magnetic Screens Company, a division of Caruso Consulting Co Ltd ("we", "us" or "our"). It forms part of our Terms & Conditions and does not affect your statutory rights as a consumer.

What we never limit

Nothing on this page or anywhere on this site excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for the breach of a guarantee we have expressly given, or for anything else that cannot be excluded under Hong Kong law. Under the Control of Exemption Clauses Ordinance (Cap. 71), an exclusion of liability for death or personal injury from negligence is void (section 7), and as against a consumer the implied conditions of the Sale of Goods Ordinance (Cap. 26) cannot be excluded either (section 11). We do not attempt them.

Other losses

For other losses, our liability to you in connection with an order is limited to the price you paid for that order, and we are not liable for loss that was not reasonably foreseeable to both of us when the contract was made. Any limitation applies only so far as it satisfies the reasonableness requirement of the Control of Exemption Clauses Ordinance (Cap. 71).

Fitting and cutting

Our screens are supplied for you to cut and fit yourself. You are responsible for measuring your own opening, for cutting safely, and for working safely at height, which matters in Hong Kong's high-rise homes. Take the usual care with a blade or with strong scissors. We are not liable for damage caused by a screen fitted contrary to the instructions supplied with it.

What a screen is and is not

An insect screen is an insect barrier. It is not a safety barrier, not a security device and not a child or pet restraint, and it must never be relied on to stop anyone or anything falling from a window. Pet mesh resists claws; it does not turn a window into a safe place to leave an animal unattended, and it is no substitute for the window guards used in high-rise flats.

Your indemnity

You agree to indemnify us against claims, losses and reasonable costs arising from your misuse of this site, from your breach of these terms, or from your use of a product in a way it was not supplied for. This does not apply to anything caused by our own breach.
